What is a Prospective Marriage visa (Subclass 300)?
The Prospective Marriage visa (PMV) or (fiancé visa) is for people who are planning to get married to an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen. Children can be included in a prospective marriage visa application. Some people call this visa the Prospective Spouse Subclass 300 visa.
Once your visa application has been approved, you can move to Australia to marry your sponsor. You can also have your wedding overseas. It’s your choice! The PMV is granted for 9 months, you are expected to get married within that 9 months and the 9 month clock starts ticking on the date the visa is granted.
PMV holders can apply for an 820/801 visa once they have married their sponsor, which then provides a pathway to permanent residence. The PR pathway is: subclass 300 > 820 > 801.
This PMV must be applied for whilst you are overseas and you can be inside or outside Australia when your PMV is granted.
Some PMV applicants will travel to Australia on a visitor visa to spend time with their sponsor during the PMV processing period. Unfortunately, not all PMV applicants will be granted a visitor visa to come to Australia.
Eligibility for a Prospective Marriage visa Subclass 300
- you must be sponsored, and
- be 18 years old or older, and
- intend to marry your prospective spouse before the 9 month visa period ends
Have a sponsor
You and anyone who applies for the visa with you must be sponsored by your prospective spouse. The sponsorship application must be approved.
Length of stay
You can live in Australia for up to 9 months from the date upon which your visa is granted.
Children
Dependent children or stepchildren can be included in your PMV application. Children must meet Australia’s health and character requirements. Once the visa is granted, your children will have the same rights and visa conditions as you.
With a Prospective Marriage visa, you can
- work in Australia
- live in Australia for up to 9 months from the date of your visa grant
- travel in and out of Australia as many times as you wish whilst you hold this visa.
- study in Australia at your own expense
