Skillselect is an invitation based system for skilled workers and business people. The three pathways for skilled workers (other than employer sponsored pathways) under Skillselect are the Skilled Independent visa (Subclass 189), Skilled Nominated visa (Subclass 190) and Skilled Work Regional (Provisional) visa (Subclass 491).
How Skillselect Works
The first stage is the Expression of Interest (EOI). An EOI is a request by you, to the Department of Immigration and Border Protection, to be invited to make a visa application. You will be requested to provide a range of information depending on the type of visa(s) you are interested in applying for. You can elect to apply for one or more of the above pathways in the same EoI, however it is better to lodge a separate EOI for each pathway. Whether or not you are invited to apply for a visa is determined determined by a points system and government planning levels.
The points system takes into account your age, qualifications, work experience, English language ability and several other factors. The Independent (Subclass 189) visa requires that your occupation is on the relevant Skills List . The Skilled Nominated and Skilled Regional visas require that your occupation be on the relevant Skills List AND obtain State Nomination from the State you intend to migrate to. If you are eligible for a Skilled Nominated visa (Subclass 190), the nominating state will give you an extra 5 points and If you are eligible for a Skilled Work Regional (Provisional) visa (Subclass 491), the nominating state will give you an extra 10 points.
In most cases, a successful skills assessment by the Australian assessing body mandated by the Department of Home Affairs (DHA) for your particular trade or profession is an essential part of the application process. The skills assessing bodies are very exacting in their requirements, particularly in the area of the trades. Failure rates are high.

If you do not have the required number of points, you will not be invited to apply. If you are invited to apply and you cannot substantiate the information you provided in your EOI, your visa application will be refused. Therefore, a well prepared and substantiated EOI is essential.
The second stage is your visa application. The quality and content of your documentary evidence will impact upon the speed at which your application is processed by the Department of Home Affairs. Inadequate content, information inconsistent with your EOI or previous visa applications, or incorrectly completed application forms may result in your application being refused. The Department’s visa application charges are generally non-refundable in the event of a refusal.
